Francis knows there are all sorts of issues inside and outside the Church where for too long people with power have tried to keep the lid on, in the hope that the problems and complexities will go away, often by parodying those who see the problems or complexities as small 'l' liberals or cafeteria Catholics. He delights in being joyful and troubled while contemplating big problems, calling people of good will to the table of deliberation reminding them of the kernel of the Christian gospels. He has the faith and hope needed to lift the lid without fear and without knowing the answers prior to the dialogue occurring.
It is now more than three years (and three prime ministers) since the expert panel set up by the Gillard government reported on how the Constitution might be amended to provide recognition of Aboriginal and Torres Strait Islander peoples. When I read the report, my heart sank. It had put forward a comprehensive, but unachievable and unworkable proposal for change. The lesson from 1967 is that a modest change carried overwhelmingly by the Australian people provides the impetus for change.
I acknowledge those Aborigines and Torres Strait Islanders who insist that they have never ceded their sovereignty to the rest of us. I join with those Aborigines and Torres Strait Islanders who hope for better days when they are recognised in the Australian Constitution. As an advocate for modest constitutional recognition for Indigenous Australians, I respect those Aborigines and Torres Strait Islanders who question the utility of such recognition. But I do take heart from President Obama's line in his Charleston eulogy for the late Reverend Clementa C. Pinckney: 'Justice grows out of recognition'.
Pope Francis's concerns are not narrowly dogmatic or pedagogical but universally pastoral. He knows that millions of people, including erstwhile Catholics, are now suspicious of or not helped by notions of tradition, authority, ritual and community when it comes to their own spiritual growth which is now more individual and eclectic. He wants to step beyond the Church's perceived lack of authenticity and its moral focus on individual matters, more often than not, sexual. He thinks the world is in a mess particularly with the state of the planet — climate change, loss of biodiversity and water shortages, but also with the oppression of the poor whose life basics are not assured by the operation of the free market, and with the clutter and violence of lives which are cheated the opportunity for interior peace. Australia is more mature and more complex than it was at the time of the 1967 Aboriginal citizenship referendum. We need to be very attentive to the diversity and (hopefully) emerging consensus of Aboriginal viewpoints. We also need to be attentive to what measures the leaders of our major political parties will be prepared to sponsor during the life of the next parliament, championing those measures in a referendum campaign.
This year's NAIDOC Week theme calls on Indigenous Australians to value their inheritance and to nurture it. It also challenges other Australians to be curious about the heritage of their Indigenous brothers and sisters, and to respect it in the uses to which their lands are put to.
The past week's meeting at Kirribilli House between Aboriginal and Torres Strait Islander leaders and politicians decided on the establishment of a Referendum Council. We should not overlook the power of the land itself to reconcile us. Theologian, archaeologist, and biblical scholar Eugene Stockton, along with artist Terence O'Donnell, has just produced a timely booklet titled This Land, Our Mother.
Those Aborigines who are most at home in modern Australia tend to be those with a secure foothold in both the Dreaming and the Market. Those who are most alienated and despairing are those with a foothold in neither. Constitutional change alone won't make things better. But a good Constitution is a better complement to other measures – such as a statutory charter – than a bad one.
The phrase 'the public square' is peppered throughout Frank Brennan's work. The 1988 film Cinema Paradiso depicts the public square in a Sicilian village over 30 or so years, and its slow and subtle change from a place where human beings gather to laugh, play and discuss. Billboards and garish signs appear and it becomes a car park bereft of its humanity.
As much as any other religious figure in Australia, Frank Brennan has maintained a religious perspective while engaging in issues of ethics and justice in contemporary Australia. His book Amplifying that Still Small Voice emphasises the importance of the 'religious sense that the human person is created in the image and likeness of God', while speaking in the language and terms that are understandable to the public square.
Walking towards the courthouse, I heard a cry, 'Hey, Father Frank, over here! You've got to support us mob.' I was torn. I was chairing a national consultation at the request of the Commonwealth Government. I did not want to politicise our presence in town. But then again, I did not want to abandon Ben and his colleagues in their hour of need. They all stood in front of an Aboriginal flag. Some were crying out for justice for their deceased loved one.
